Criminal Defense Trial Records

I’ve recently had a few clients mention to me that they had initial consultations with certain Phoenix-area attorneys who boasted jury trial records of more than twenty acquittals without a single conviction. I would have assumed they were exaggerating if they weren’t all saying the same thing. Maybe I’m wrong, but it seems to me that attorneys with jury trial records of twenty or more wins without a loss are exceedingly rare. I’m certain there are attorneys out there with records like that, but multiple attorneys within a five-mile radius? In my experience, a case that’s close to a guaranteed winner will get dismissed prior to trial more often than not, so the ones that go to trial tend to have a less than perfect defense. Can't Make Out Your VIN?

If your answer to that question is “yes,” there’s a chance your vehicle is going to become property of the State of Arizona at some point in the future. A.R.S. § 28-4594(A) provides that when the VIN of a vehicle or of a major component of a vehicle has been removed, defaced, altered or destroyed without the permission the Arizona Department of Transportation, the vehicle is contraband. If the state decides your vehicle is contraband, it can seize and destroy it. Is the Town of Gilbert in the Business of Stealing Cars?

If you are caught driving and have a revoked or suspended driver’s license, Gilbert will impound your car. The same is true if you never had a driver’s license, if you are arrested for Extreme DUI or Aggravated DUI, if you are under the legal drinking age and have any alcohol in your body, or if you are operating a vehicle without a certified ignition interlock device and you’re supposed to have one. Actual Control (Again)

Recently, I was surprised when Division Two looked at an issue very close to (if not the same as) something I previously discussed in a post. The issue in State v. Zaragoza was “actual control,” and most of the commentary I’ve read seems to claim that the opinion narrows the term significantly. Here it is. Although I have no doubt that it’s a step in the right direction and may well assist me in future motions, I am skeptical about how positive an effect the opinion is likely to have. Like any appellate opinion, it can be narrowed by its facts. Classes of DUI

A DUI can be either a misdemeanor or a felony. For your run-of-the-mill first DUI, whether you have a blood alcohol concentration just over the legal limit or a blood alcohol concentration three times the legal limit, although the mandatory jail sentences differ, the charge will be a class 1 misdemeanor. However, a regular DUI can become a felony and be considered “aggravated” if, among other things, you had a suspended license, two prior DUIs in the past seven years, or a person under fifteen years of age in the car.
