A Disgrace

It appears that at some point the fame finally got to L. Kirk Nurmi, former lawyer for celebrity capital defendant Jodi Arias. After he came out with a tell-all book about representing his famous client called “Trapped with Ms. Arias,” the equivalent of wiping his ass with ER 1.6, Scott Greenfield at Simple Justice got right to the root of the problem: Did Arias consent to Nurmi’s disclosure? Did Nurmi obtain consent after disclosing to Arias what he would be revealing? Given what Nurmi has to say about Arias, it seems inconceivable, and even if it was conceivable, there remains the problem of Arias being disturbed, as Nurmi claims, such that she would be incapable of consenting as lacking the capacity. Because she’s friggin’ disturbed. And yet, there it is, … Read entire article »

Who Needs Lawyers Anyway?

I came across a fascinating post about the unauthorized practice of law after Mauricio Hernandez at the Irreverent Lawyer wrote a post of his own discussing it. It was the sort of thing that took a little time for me to digest before writing about it. For those too lazy to click through, the original article is about a woman with a very strong background in criminal law who moved here then took and passed the Arizona bar before becoming a capital staff attorney in Maricopa County. Ignoring some off-putting personal attacks that may or may not be deserved and a bizarre part in the closing paragraph that tries to make it a red-state-blue-state political problem, it’s a thought-provoking piece about the flagrant unauthorized practice of law by a … Read entire article »

So You Want to Go to Law School?

I may be too busy to blog this week and last, but I’m not too busy to post this video: I could do without some of it, but I’ve gotta say that disgruntled young lawyers who got into this profession for the wrong reasons have to be some of the funniest people on earth. H/T Clooch, Koehler … Read entire article »

When to Go Solo

Posts here and here bring up interesting points about going straight into solo practice out of law school. While good reading, for the most part, I don’t agree with them. Adrian and I went into solo (or is it duet?) practice straight out of law school. Throughout law school, I intended to do criminal defense and nothing else. I wanted to fight the big, bad government. My goal, which I made clear to everyone around me, was to immediately hang out a shingle upon receipt of my bar number. I set aside time to watch court. I did a public defender clinic, attended public defender new hire training, spoke with a number of judges, and met as many good criminal lawyers as I could. … Read entire article »

The Myrtle Beach Dilemma

There’s been a good bit of news lately about Myrtle Beach trying to rid itself of bikers. I expected to hear a lot about it from bikers (here’s an account from a biker who engaged in a bit of civil disobedience), but I was pleasantly surprised to see at least one member of the blawgosphere pick up on the story as well (check out posts from Bobby G. Frederick here and here). Anyone who knows me or has had a look around my firm’s website realizes that both Adrian and I are avid bikers. I donate a lot of my time to fellow bikers and bikers’ rights organizations, so this Myrtle Beach business is right up my alley. Strangely, I don’t know what I’d recommend. On one … Read entire article »
