Guilty Until Proven…

Oh, who am I kidding? They aren’t even going to let you prove yourself not guilty. Not before it’s too late, at least. I’m talking about the Town of Gilbert again, and this time it isn’t your car or your money that they’re after. It’s your driver’s license. Is Gilbert The New Castle Rock?

I recently had a change of plea for a DUI in Gilbert where I started to feel like I was in a Stephen King novel. Gilbert has several policies that seem extreme even in Maricopa County. Matt has previously pointed out Gilbert’s policy for vehicles impound in a previous post, so I’ll concentrate on two other aspects that irk me. First, the plea deal stipulates to five years of probation. In my opinion that is simply absurd. Why in the world does a first time offender need a probation period of 60 months? The judge was gracious enough to modify the terms so probation terminates upon completion of certain alcohol classes. Is the Town of Gilbert in the Business of Stealing Cars?

If you are caught driving and have a revoked or suspended driver’s license, Gilbert will impound your car. The same is true if you never had a driver’s license, if you are arrested for Extreme DUI or Aggravated DUI, if you are under the legal drinking age and have any alcohol in your body, or if you are operating a vehicle without a certified ignition interlock device and you’re supposed to have one.
