Rock Bottom

At a hearing earlier this week, I mentioned to the judge how a police officer unfairly targeted my client. It seemed to me that the cop was clearly out to get him. The judge laughed, “he’s a motor; of course he’s out to get your client, those guys are out to get everyone.” The prosecutor laughed too. The judge then mentioned how he gets extremely nervous every time he’s driving his car and sees a “motor” sitting there on a motorcycle, just waiting to catch someone for something. “I keep my hands at ten and two, go under the speed limit, and only look straight ahead,” he joked. Move Along, No Preferential Treatment Here

Last Thursday, we faxed a motion to continue trial to Mesa Municipal Court at 10:02 a.m. We sent the state a copy too, of course, though we’d also told the assigned prosecutor what we were going to do the day before. The court called us at 2:25 p.m. and left a message about getting our position on the state’s motion to continue trial. That’s right, the state’s motion. Not ours. The motion the state didn’t bother faxing us until 3:45 p.m. I called the court back sometime shortly before 5:00 p.m. and spoke with a very pleasant lady. Some (Un)Sound Advice

I often hear some really dumb things from prosecutors, but yesterday, I might have heard one of the dumbest things to date. It was in a DUI drug case where the prosecutor made a plea offer with no benefit to my client. I filed a number of motions, and yesterday was the motion hearing. From the beginning, my client has wanted to plead. He just doesn’t want to lose his license for a year, which is the case with DUI drugs, so we asked for him to plead to DUI for being impaired to the slightest degree, a different subsection with a 90-day license suspension attached.
