Tempe’s Perverted Priorities

A recent article about Tempe discusses some new cash coming in for a very important purpose: The Tempe Police Department has been awarded a grant worth more than $360,000 to tackle a backlog of untested rape kits. “We are looking at several hundred kits at least,” Mike Pooley, a lieutenant with the Tempe Police Department, said. There are rape kits stacked to the ceiling in evidence vaults around the state and Tempe is no exception. Detectives can only guess 500 or more kits deserve to be tested and reviewed. If you’re thinking Tempe has prioritized the investigation and prosecution of rapes as something urgent, though, you’re crazy. How does that make them any money? At any given time, my caseload involves at least one person who got caught taking a leak in some dark … Read entire article »

Nothing Better To Do

My biggest takeaway from State v. Foncette is that there must be no crime in Tempe. Officers stopped Foncette, apparently smelled marijuana, and brought a drug dog to the scene. The dog alerted, but they found nothing. They proceeded to follow him to a hotel and walked with the dog down the hallway outside of the room where he was staying. The dog alerted outside of his room, and officers knocked. When he opened the door, officers apparently smelled marijuana again. Foncette left the room when officers asked, but his companion did not. Police then detained both of them, and they subsequently got a warrant for a nighttime search of the hotel room. They found a lot of marijuana. Obviously, there were no burglaries in Tempe that night. I am sure … Read entire article »

Attorney At Law Magazine

There’s this thing called Attorney At Law Magazine here in Arizona. It’s a fairly slick-looking magazine I get regularly despite never having subscribed. I just got one last week, in fact. Looking around a bit, I actually realized there are things called Attorney At Law Magazine in a whole bunch of places (like California, Florida, Georgia, Kentucky, Louisiana, Massachusetts, Michigan, Minnesota, Mississippi, Nevada, New Jersey, North Carolina, Pennsylvania, Texas, Utah, and Virginia). What’s going on? Attorney At Law Magazine isn’t really a magazine in what I’d consider the traditional sense at all. The lawyers’ “articles” there are hardly Pulitzer Prize material; they basically make it look like the magazine just keeps realizing how awesome various rotating superstar lawyers with sexy pictures are and decides to report … Read entire article »

Cracking Down On College

A recent article explained, “Tempe kicks off ‘Safe and Sober’ campaign but without ASU.” The emphasis is mine, but it doesn’t really need it. What were you thinking, ASU? Do you have a problem with safety? Sobriety? The gist of the article is that people visiting Tempe last weekend were going to see a massive police presence as officers from nine agencies teamed up for the “Safe and Sober” campaign, something that as near as I can tell is intended to violate the constitutional rights of hundreds of innocent people in a valiant effort to make college suck. Shamefully, ASU police did not participate. Tsk, tsk. Another article lays out the stats: Total stops: 1,812 Total citations: 919 Total arrests: 486 Arrests for minors in possession of alcohol: 208 Total DUI … Read entire article »

It’s Lonely Being Perfect

I set aside a few hours on several different days during my recent hike to make sure everything was okay back at the firm. On those partial “work” days, I mostly made sure my clients were happy and everything was going as planned in their cases. I returned calls from a few prospective clients as well. At first, the prospective clients would leave polite messages. They’d ask that I call them back at my convenience, acknowledging that my voice mail greetings said I would have limited availability until May. A few wished me well on my walk and said they’d be contacting Adrian because time was of the essence. What nice people I get to meet sometimes. At some point after climbing onto the Colorado Plateau, however, … Read entire article »

The Simpsons Already Did It

I’m about ready to boycott Facebook. I suppose I could marvel at the diversity of my friends’ political views, but it’s mostly just draining. Half of them are stockpiling weapons. The other half are champing at the bit for some sort of action, any action, from legislators. Why they feel the need to share their views in impersonal snippets bound to piss off half of their “friends” is beyond me. Personally, I’ve avoided posting anything about last week’s tragedy because it has seemed far too soon for me to know what lessons I should be taking away from it, if there are any at all. It’s also far easier to make sense of other people’s reactions than it is to make sense of what happened. After I … Read entire article »

Movin' On Up

I haven’t had much time to write these past few weeks due in large part to the fact the firm has moved. We are now located in Tempe, much closer to Phoenix and most of the courts where we usually practice. The move actually happened on the 1st of January, more or less, but the transition was still happening until this week. For all I know, it may well continue happening for weeks to come. I say that because it turns out Brown & Little, P.L.C., is the first business in the history of the world to move offices. I know it seems implausible, but I am certain you’d agree if you got to see how more or less every vendor involved dealt with the logistics … Read entire article »
