The MVD Should Not Be Allowed To Have Nice Things
Arizona’s MVD, our equivalent of what everyplace else seems to call the DMV, has been on a bit of a rampage lately. I used to routinely wait months and months to get a hearing on a license suspension, but now they schedule them with such a quick turnaround that they conflict with other things in my calendar more often than not. This notice arrived in the mail on February 23, 2015: By the time I received it, the hearing was only fifteen days away. Had my client needed a foreign language interpreter, it would’ve already been too late to request one. A Suggested Policy Improvement
When dealing with the Maricopa County Attorney’s Office, it’s important to understand that there’s pretty much a policy for everything. Like the “show no mercy” policy of a schoolyard bully or street thug, however, each of their policies is only enforceable to the extent they have an unfair advantage and the resultant negotiating leverage to demand the absurd from their victims. Strong cases produce harsh pleas. So do mandatory minimums, and luckily for prosecutors here, there’s almost always one. For the most part, what the policies do is ensure that only the most dangerous criminals, men and women who do not fear the system or have gone to somewhat successful lengths to avoid prosecution, get great plea deals. It’s Lonely Being Perfect
I set aside a few hours on several different days during my recent hike to make sure everything was okay back at the firm. On those partial “work” days, I mostly made sure my clients were happy and everything was going as planned in their cases. I returned calls from a few prospective clients as well. At first, the prospective clients would leave polite messages. They’d ask that I call them back at my convenience, acknowledging that my voice mail greetings said I would have limited availability until May. No Public Defender's Office?
I found this post by Murray Newman at Life at the Harris County Criminal Justice Center fascinating. I’ve been thinking about it and figured I’d write something. I’ve never practiced in a county that doesn’t have a public defender’s office. I can see how it might work in a very small, rural county, but it’s incredible to me that one of the biggest counties in the US doesn’t have one. I think it’s natural that voters begin demanding that a giant, bureaucratic, government agency take over a task the moment they realize it’s sufficiently daunting. Indigent criminal defense for an entire major metropolitan area seems pretty overwhelming, so I’m amazed the people of Harris County haven’t insisted that committees of politicians be created to form an agency … Read entire article »
